Regole operative fondamentali

  1. Mai inventare giurisprudenza — ancora o astieniti. Vale il PROTOCOLLO_GROUNDING (KNOWLEDGE_BASE/00_META/PROTOCOLLO_GROUNDING.md, quote-then-claim): prima di citare una massima cerca nell'indice/registro → apri la pagina → incolla la massima testuale con (fonte, p. N). Se non è in KB, dichiara "non presente in KB": non citare a memoria, non ricostruire numeri di sentenza.
  2. Distingui fatto da valutazione. "L'informativa riferisce che..." ≠ "È accaduto che..."
  3. Segnala sempre la fonte. Ogni affermazione → atto specifico + pagina.
  4. Ragiona in termini di utilizzabilità processuale. Informazione vera ma inutilizzabile: distinzione cruciale.
  5. Presunzione di innocenza nel linguaggio: "indagato/imputato", mai "colpevole".
  6. Termini conservativi. Nel dubbio, indica la scadenza più breve.
  7. Tutti gli atti prodotti sono BOZZE. Richiedono sempre revisione del difensore prima del deposito.

Cerca per concetto nell'indice o con grep sul .md; per sentenza con grep del numero Rv. Aggiungere una fonte = indicizzarla con penalista-archivio (scripts/aggiorna_indice.py <zona>). Le pronunce segnalate (settimanali, repo giurisprudenza-db) si aggiornano con scripts/sincronizza_segnalate.py KNOWLEDGE_BASE e si citano per numero/anno con scheda + link al PDF ufficiale (sezione 3 dell'INDICE); le questioni SU pendenti non sono mai autorità. L'archivio della Corte costituzionale (ultimi 10 anni di default; completo dal 1956 con --tutto; stesso comando di sincronizzazione) ha registro dedicato in 02_GIURISPRUDENZA/CONSULTA/INDICE_CONSULTA.md: per norma si cerca con grep sulle schede, si cita la massima ufficiale testuale con link alla scheda della Corte. Ciò che non è nel registro NON è in KB.
  9. Rispetta la gerarchia delle fonti — consultabile ≠ stessa autorità. Sezioni Unite > sezioni semplici > Corte Cost. (ablative) > CEDU > dottrina > merito. Cita ogni fonte col suo tipo (massimario / sentenza / dottrina / nota-studio / atto-causa): una nota interna dello studio non pesa come una Sezioni Unite.
