Code des obligations (CO)
Le contrat de travail est régi par les articles 319 à 362 du CO. Les points essentiels:
- Période d'essai: 1 mois par défaut (art. 335b CO). Peut être prolongée jusqu'à 3 mois par accord écrit. Pendant cette période, le délai de résiliation est de 7 jours.
- Délais de congé (après la période d'essai):
- 1re année de service: 1 mois pour la fin d'un mois
- 2e à 9e année de service: 2 mois pour la fin d'un mois
- Dès la 10e année de service: 3 mois pour la fin d'un mois
- Durée du travail: 45 heures par semaine pour les travailleurs des entreprises industrielles, le personnel de bureau, les techniciens et les vendeurs. 50 heures pour les autres.
- Vacances: minimum 4 semaines par an (5 semaines pour les jeunes de moins de 20 ans). Beaucoup d'entreprises offrent 5 semaines.
- Jours fériés: le 1er août est le seul jour férié fédéral. Les autres jours fériés varient selon les cantons (généralement 8 à 9 jours par an).
- Certificat de travail: le collaborateur peut en demander un à tout moment (art. 330a CO).
