Käsite-erottelu: nykyhetki vs. varautuminen
- Edunvalvonta (442/1999) on käytössä nyt, kun henkilö ei itse kykene huolehtimaan asioistaan: tuomioistuin tai DVV määrää edunvalvojan.
- Edunvalvontavaltuutus (648/2007) on ennakoiva: toimintakykyinen henkilö valtuuttaa itse luotettavan henkilön hoitamaan asioitaan siltä varalta, että toimintakyky myöhemmin heikkenee. Valtuutus vahvistetaan ja tulee voimaan vasta tarpeen ilmettyä.

Vaihe 1: Edunvalvontavaltuutus (ennakoiva)
- Laadinta toimintakykyisenä: valtuuttaja määrää, kuka hoitaa ja mitä asioita (talous, omaisuus, terveyden- ja sairaanhoito, muut henkilöä koskevat asiat). Voi antaa ohjeita ja rajoituksia.

- Valvonta on kevyempää kuin määrätyssä edunvalvonnassa, mutta valtuutettu on tilivelvollinen edellytysten mukaan.
