Hankintayksikölle: päätös ja sopimus
- Hankintapäätös (123 §) — kirjallinen, perusteltu päätös kaikista tarjoajien asemaan vaikuttavista ratkaisuista. Perusteluista on käytävä ilmi vertailun tulos ja syyt: pisteet, sanalliset perustelut vertailuperusteittain, voittajan edut suhteessa muihin. Heikot perustelut ovat yleinen kumoamisperuste — kirjoita niin, että hävinnyt ymmärtää sijoituksensa syyt.
- Tiedoksianto valitusosoituksineen (sähköinen tiedoksianto; muutoksenhakuohjeet markkinaoikeuteen ja hankintaoikaisuun).
- Odotusaika (129 §) — EU-kynnysarvon ylittävissä hankinnoissa
sopimusta ei saa tehdä ennen odotusajan päättymistä

Hankintaoikaisu (132–133 §)
- Hankintayksikkö voi itse korjata virheellisen päätöksensä — omasta aloitteesta tai asianosaisen vaatimuksesta; määräajat lähteestä.
- Tarjoajalle: hankintaoikaisuvaatimus on nopea ja halpa, mutta ei jatka markkinaoikeuden valitusaikaa — tee molemmat rinnakkain, jos intressi on suuri.
- Hankintaoikaisu ei edellytä asianosaisen suostumusta, mutta sopimuksen tekeminen rajoittaa käyttöä — tarkista rajat lähteestä.
