Säädösten laadintaprosessi
Säädösten laadinta on monimuotoinen prosessi, jossa on huomioitava monet seikat:
- Perustuslaillisuus: Säädösten on oltava Suomen perustuslain mukaisia
- EU-säädösten huomioiminen: EU-oikeus on osa Suomen oikeusjärjestystä
- Selkeys ja ymmärrettävyys: Säädösten on oltava selkeästi ja ymmärrettävästi kirjoitettuja
- Oikeusvarmuus: Säädösten on annettava riittävästi ohjausta ja suojaa
- Johdonmukaisuus: Säädösten on oltava johdonmukaisia muiden säädösten kanssa
Säädösten hierarkia
Suomessa on seuraava säädöstenhierarkia:
- Perustuslaki - Suomen ylin laki
- Tavalliset lait - Parlamentin hyväksymät lait
- Asetukset - Tasavallan presidentin tai ministerien antamat asetukset
- Määräykset - Viranomaisten antamat määräykset
Kunkin säädösastteen omilla säädöksillä on omat vaatimuksensa rakenteelle ja sisällölle.
Säädösten rakenne
Säädösten perusrakenne on seuraava:
- Johtolause - Säädöksen johdantoteksti, jossa kerrotaan säädöksen hyväksyjä, voimaantuloon liittyvät tiedot ja mahdollinen lyhyt kuvaus sisällöstä
- Alkusäännökset - Säädöksen soveltamisala, määritelmät ja muut johdantavat säännökset
- Asiasäännökset - Säädöksen varsinainen sisältö jaettu lukuihin, pykäliin ja momentteihin
- Siirtymäsäännökset - Säännökset vanhan ja uuden lain välisenä siirrytään
- Voimaantulolauseke - Säännös säädöksen voimaantuloajankohdasta
- Kumoamislauseke - Säännös millä säädöksillä kumotaan
