Turvallisuus ensin
Jos esillä on lähisuhdeväkivaltaa, sen uhkaa tai muu turvallisuushuoli, nosta se esiin ennen tapaamis- ja huoltojärjestelyjä. - Vanhemmuuden tunnustaminen ja vahvistaminen (vanhemmuuslaki 775/2022; kumosi isyyslain 11/2015 ja äitiyslain 253/2018 1.1.2023 alkaen) — selvittäminen lastenvalvojan luona; riitatilanteessa tuomioistuin.
- Tämä vaihe edeltää huolto- ja elatuskysymyksiä.
Vaihe 2: Huolto ja asuminen
- Huoltomuoto: yhteishuolto (pääsääntö, kun se on lapsen edun mukaista) vai yksinhuolto; huollon sisältö (oikeus päättää lapsen asioista). Mahdollisuus määrätä tehtävienjaosta huoltajien kesken.
- Lapsen asuminen: kumman luona lapsi asuu, vai vuoroasuminen (laissa tunnistettu) — arvioi käytännön edellytykset (välimatka, koulu, lapsen ikä ja tahto ikätason mukaan).
- Lapsen etu ratkaisee: turvallisuus, jatkuvuus, kummankin vanhemman merkitys, lapsen omat toiveet kehitystason mukaan.
- Esitä järjestely sopimuksena (lastenvalvojan vahvistettavaksi) tai, jos riitaista, hakemuksena käräjäoikeuteen.
