Vaihe 1: Laillisuusperiaate ensin
- Onko teko tekohetkellä laissa rangaistavaksi säädetty? Ilman lakia ei ole rikosta eikä rangaistusta. Ankaramman lain taannehtiva soveltaminen ja syytetyn vahingoksi tehtävä analoginen tulkinta ovat kiellettyjä.
- Tunnista oikea tunnusmerkistö ja sen lähde (rikoslain luku ja pykälä) — älä venytä tunnusmerkistöä tekoon, joka ei siihen sovi.
Vaihe 2: Objektiivinen tunnusmerkistö
Käy tunnusmerkistötekijät läpi yksitellen:
- Tekijä ja teko — kuka teki, mitä laissa kuvattua tekoa.
- Seuraus ja syy-yhteys — seurausrikoksissa seuraus ja sen syy-yhteys tekoon (myös laiminlyönti, jos toimimisvelvollisuus).
- Olosuhdetunnusmerkit — esineen, kohteen tai aseman vaatimukset.
- Kvalifiointi/privilegiointi — törkeä tai lievä tekomuoto (ankaroittavat/lieventävät tunnusmerkit) erikseen.
Vaihe 3: Syyksiluettavuus
- Tahallisuus vai tuottamus? Useimmat rikokset edellyttävät tahallisuutta; tuottamus on rangaistava vain, kun laki niin säätää. Selvitä vaadittu syyksiluettavuuden laji ja taso.
- Tahallisuuden kohde kattaa tunnusmerkistötekijät; erehdys tosiseikasta tai (rajatusti) kiellosta voi poistaa tahallisuuden tai vastuun — arviointi lähteestä.
- Syyntakeisuus: ikä (rikosoikeudellinen vastuuikäraja) ja mielentila (syyntakeeton/alentunut) vaikuttavat vastuuseen.
