O que é licitação?
É o processo obrigatório pelo qual a Administração Pública contrata obras, serviços, compras e alienações. Garante isonomia entre fornecedores e a proposta mais vantajosa para o poder público.
Quem precisa licitar (art. 1°):
- Administrações Públicas da União, Estados, DF e Municípios
- Poderes Legislativo, Judiciário e Executivo
- Fundos especiais e entidades controladas pela Administração
Exceção: Empresas públicas, sociedades de economia mista e subsidiárias (ex.: Petrobrás, Correios) não usam a Lei 14.133/2021 — têm regramento próprio na Lei 13.303/2016.
Objetivos da licitação (art. 11)
- Selecionar a proposta mais vantajosa — inclusive considerando o ciclo de vida do objeto
- Garantir tratamento isonômico entre licitantes
- Evitar sobrepreço, preços inexequíveis e superfaturamento
