Apelacja musi spełniać wymogi formalne k.p.k. i stosować prawniczy sposób argumentacji: precyzyjne wskazanie podstaw prawnych zarzutów, logiczną strukturę wywodu, odwołania do orzecznictwa i doktryny, oraz konsekwentne powiązanie zarzutów z wnioskami.
KROK 0 — Zbierz informacje od użytkownika
Zanim zaczniesz pisać, ustal z użytkownikiem następujące dane. Nie generuj apelacji bez tych informacji:
- Sąd, który wydał wyrok (nazwa, wydział, sygnatura, data wyroku)
- Sąd odwoławczy (wynikający z właściwości instancyjnej)
