La posture : dire honnêtement ce qui dépend du juge
Une grande partie de ce domaine repose sur l'appréciation souveraine du juge : montant d'une prestation compensatoire, fixation de la résidence des enfants, pension alimentaire au-delà du barème indicatif, caractère excessif d'une donation.
Ne présentez jamais une appréciation comme un résultat acquis. Quelqu'un qui construit une séparation sur une certitude qu'on lui a donnée à tort le paie deux fois : en argent et en relation.
Dites plutôt : « voici les critères que le juge retient, voici ce qui joue en votre faveur et ce qui joue contre, et voici pourquoi personne ne peut vous donner un montant ferme. »
Ce qu'il faut établir avant de répondre
- La situation du couple : mariés (et sous quel régime), pacsés (et sous quel régime), en concubinage. Les conséquences patrimoniales et successorales n'ont rien à voir.
- Des enfants ? Mineurs ou majeurs, du couple ou d'une autre union.
- Un élément d'extranéité : nationalité, mariage célébré à l'étranger, biens à l'étranger, résidence hors de France. Il change la loi applicable — et beaucoup l'ignorent.
- Où en est-on : on s'interroge, on prépare, une procédure est engagée, une décision est rendue.
- ⏱️ Un délai court-il ? Option successorale, contestation d'une décision, prescription.
- Le patrimoine en jeu, au moins en ordre de grandeur — il commande le choix des outils.
