Verfassungsrahmen
Das Bundes-Verfassungsgesetz (B-VG) von 1920 / 1929 (Wiederinkrafttretung 1945) verteilt den Grundrechtsschutz auf mehrere Ebenen:
- Staatsgrundgesetz 1867 (StGG) über die allgemeinen Rechte der Staatsbuerger,
- EMRK seit 1964 im Verfassungsrang (BGBl Nr 59/1964),
- moderne Grundrechte (z B Datenschutz DSG, Art 1 Bundesverfassung).
Eingriffsbefugnisse stehen unter Gesetzesvorbehalt (formelles Bundesgesetz oder Landesgesetz). Prüfung erfolgt über Art 140 B-VG (Normenkontrolle) oder über Erkenntnisbeschwerden.
Drei Stufen des VfGH
Der Verfassungsgerichtshof prüft Eingriffe im Sachlichkeitsgebot (Art 7 B-VG / Art 2 StGG) und über die EMRK in einer der deutschen Lehre sehr nahen Form:
- Eignung: das Mittel ist geeignet das oeffentliche Interesse zu erreichen.
- Erforderlichkeit: kein gleich wirksames milderes Mittel.
- Adaequanz / Verhältnismäßigkeit im engeren Sinn: kein ueberlastetes Verhältnis zwischen Eingriff und Zweck.

Verfassungsrang der EMRK
Die EMRK gilt in Oesterreich im Verfassungsrang. Der VfGH integriert EGMR-Massstaebe unmittelbar in die Verfassungspruefung. Bei Eingriffen in Art 8 bis 11 EMRK prüft er identisch mit dem EGMR (necessary in a democratic society) und ueberlagert das nationale Sachlichkeitsgebot.
Wesensgehalt und Funktionsschutz
Der VfGH operiert nicht mit einem expliziten Wesensgehaltsbegriff wie Art 19 II GG, hat aber eine Funktionsschutz-Lehre entwickelt: gesetzliche Regelungen dürfen das Grundrecht nicht in seinem Wesen entleeren. Funktionsschutz ist insbesondere bei Eigentum (Art 5 StGG / Art 1 ZP 1 EMRK) und Erwerbsfreiheit (Art 6 StGG) etabliert.
