recht-claim-momarcode1

recht-claim-momarcode1 is a skill for Claude Code, Codex from ThomasMoreAI/legal-skills-open. It costs 51 tokens per session (2,084 once invoked), scanned A, original, Apache-2.0.

An Austrian-law claim finder that turns a described situation into possible legal claims. It links each claim to the relevant legal requirements, objections, evidence burden, and limitation issues.

In plain words
What is it for?
It reviews events, parties, dates, goals, and evidence, then checks possible claims and relevant Austrian statutes and court decisions through RIS, the Austrian legal information system.
Why use it?
People often know what happened but not which legal remedies may apply. This helps structure the facts and identify what must be proved and what deadlines may matter.

Token cost

What it costs to keep this loaded

Counted locally with the o200k_base tokenizer, which is exact for GPT models; Claude uses its own tokenizer and its counts differ. Treat this as one consistent yardstick across the catalogue rather than a bill. Prices are per million input tokens.

ModelPer sessionOnce invoked
Fable 5.1 $0.00051 $0.02084
Opus 5.5 $0.00020 $0.00834
Sonnet 5.5 $0.00010 $0.00417
Haiku 4.5 $0.00005 $0.00208

Security

Grade A, and why

recht-claim-momarcode1 scanned grade A with 0 findings against 26 rules in 11 categories — prompt injection, anti-refusal, data exfiltration, privilege escalation, supply chain, agent snooping, system-prompt leakage, SSRF and excessive agency — measured 24d ago.

A static scan of the body, not an audit. Every finding is printed with the line that produced it so you can judge whether it matters here. A mod is markdown that instructs an agent; that is exactly why what it instructs is worth reading.

Nothing flagged

None of the 26 patterns this scan looks for appear in this file: no shell pipes, no recursive deletes, no credential paths, no hidden text, no instruction-override or anti-refusal phrasing, no agent-config snooping. That is not a guarantee, it is the absence of the things that are checkable.

/recht claim — Anspruchsprüfung

When the user describes a factual situation and wants to know their legal options, follow these steps.

Step 1: Gather the Facts

Read what the user has provided. You need:

  1. What happened? — Chronological sequence of events
  2. Who is involved? — Parties, their roles, consumer or business?
  3. When did it happen? — Dates are critical for Verjährung
  4. What does the user want? — Money, performance, rescission, injunction?
  5. What evidence exists? — Documents, witnesses, correspondence?

If any of these is missing, ask. Be specific:

"Wann genau ist das passiert? Das Datum ist wichtig für die Verjährungsprüfung."

Step 2: RIS Verification

Before proceeding with analysis, follow the RIS Verification Protocol (references/ris-protocol.md):

  1. Check RIS MCP availability
  2. For every § you cite in this analysis, verify current wording via RIS
  3. For case law references, retrieve via RIS Justiz
  4. Record verification status for the Quellenstatus block
  5. If RIS is unavailable, follow the fallback ladder and flag all affected citations

Step 3: Identify ALL Possible Claims

Go through this checklist systematically. Check every category — users often miss claims they didn't know they had.

A: Vertragliche Ansprüche (check first — these are strongest)

Ask yourself: Was there a contract (even oral)?

If yes, check each of these:

  1. Erfüllung (§918 ABGB) — Can the user demand performance?

    • Requirements: Valid contract + obligation due + no performance yet
    • Check: Did user set a Nachfrist? (required per §918 unless entbehrlich)
  2. Gewährleistung (§§922-933b ABGB) — Is there a Mangel (defect)?

    • Requirements: Contract + Mangel at time of delivery + within Frist
    • Check: Was it a Sachmangel or Rechtsmangel?
    • Check: Did user assert it in time? (2 years movable, 5 years immovable per §933)
    • Check B2B: Did user comply with §377 UGB Rügepflicht? (unverzüglich = within ~14 days)
    • Remedies: First Verbesserung/Austausch → then Preisminderung/Wandlung (§932 ABGB Stufenmodell)

What this file has done since we first saw it

Hashed on every crawl. A supply-chain change to an agent config is a question of when, not whether, so the history is kept rather than the latest state alone.
