recht-miet-verfahren-momarcode1

recht-miet-verfahren-momarcode1 is a skill for Claude Code, Codex from ThomasMoreAI/legal-skills-open. It costs 97 tokens per session (8,081 once invoked), scanned A, original, Apache-2.0.

An Austrian tenancy-law procedure guide for disputes between renters and landlords. It covers rent reviews, repairs, termination, eviction, deposits, and other steps under tenancy rules.

In plain words
What is it for?
It helps prepare applications to a local conciliation office, rent-review and repair proceedings, challenges to termination, eviction cases, rent reductions, and deposit or key-money claims.
Why use it?
The correct authority and procedure can depend on the property’s location, the tenancy law that applies, and key dates. This helps organise those facts before taking action.

Token cost

What it costs to keep this loaded

Counted locally with the o200k_base tokenizer, which is exact for GPT models; Claude uses its own tokenizer and its counts differ. Treat this as one consistent yardstick across the catalogue rather than a bill. Prices are per million input tokens.

ModelPer sessionOnce invoked
Fable 5.1 $0.00097 $0.08081
Opus 5.5 $0.00039 $0.03232
Sonnet 5.5 $0.00019 $0.01616
Haiku 4.5 $0.00010 $0.00808

Security

Grade A, and why

recht-miet-verfahren-momarcode1 scanned grade A with 0 findings against 26 rules in 11 categories — prompt injection, anti-refusal, data exfiltration, privilege escalation, supply chain, agent snooping, system-prompt leakage, SSRF and excessive agency — measured 24d ago.

A static scan of the body, not an audit. Every finding is printed with the line that produced it so you can judge whether it matters here. A mod is markdown that instructs an agent; that is exactly why what it instructs is worth reading.

Nothing flagged

None of the 26 patterns this scan looks for appear in this file: no shell pipes, no recursive deletes, no credential paths, no hidden text, no instruction-override or anti-refusal phrasing, no agent-config snooping. That is not a guarantee, it is the absence of the things that are checkable.

/recht miet-verfahren — Mietrechtliches Verfahren

When the user wants to enforce tenant or landlord rights, challenge a termination, file for rent review, or take any procedural step in an Austrian tenancy dispute, follow these steps.

Step 1: Gather the Facts

Read everything the user has provided. You need:

  1. What has already happened? — Received a Kuendigung? Dispute about Mietzinshoehe? Mangel not repaired? Kaution not returned? Abloese paid?
  2. Has the user already taken action? — Contacted Vermieter/Mieter? Written a letter? Filed anything?
  3. Location — Which Bundesland and Gemeinde? (Determines if Schlichtungsstelle exists)
  4. Deadlines — When was a Kuendigung received? When did the Mangel occur? When was the Abloese paid? Is there a court date?
  5. MRG applicability — Was recht-miet already run? If not, clarify: Vollanwendung, Teilanwendung, or ABGB-only? (Essential for procedure choice)
  6. Financial situation — Can the user afford a lawyer? Is Verfahrenshilfe needed?
  7. Evidence — What documents exist? (Mietvertrag, Korrespondenz, Fotos, Betriebskostenabrechnung, Uebergabeprotokoll)

If critical information is missing, ask:

"Gibt es in Ihrer Gemeinde eine Schlichtungsstelle? In Wien ist die Schlichtungsstelle (MA 50) vorgeschaltet — d.h. Sie muessen dort zuerst hin, bevor Sie zum Bezirksgericht gehen koennen."

Step 2: RIS Verification

Before proceeding with analysis, follow the RIS Verification Protocol (references/ris-protocol.md):

  1. Check RIS MCP availability
  2. For every § you cite in this analysis, verify current wording via RIS
  3. For case law references (OGH, LGZ Wien), retrieve via RIS Justiz
  4. Record verification status for the Quellenstatus block
  5. If RIS is unavailable, follow the fallback ladder and flag all affected citations

Step 3: Determine the Correct Procedural Path

Decision Tree: Where to go?

3A: Schlichtungsstelle vs. Bezirksgericht

Schlichtungsstelle (Gemeindeschlichtungsstelle, in Wien: MA 50):

What this file has done since we first saw it

Hashed on every crawl. A supply-chain change to an agent config is a question of when, not whether, so the history is kept rather than the latest state alone.
