What is dilekce-ipac?

A Turkish legal-writing method that structures a petition or defence around an issue, a general legal principle or doctrine, its application, and the result. A legal doctrine is an established way of interpreting or reasoning about the law.

Use it to prepare Turkish civil or criminal petitions, responses, replies, rejoinders, and defences based mainly on broad legal principles or doctrines.

It helps when no single statute clearly settles the matter and the argument depends on principles such as good faith, abuse of rights, or unjust enrichment.

IPAC ve IDAR, IRAC'in "Kural (Rule)" basamağını genel hukuk İlkesi (Principle) veya öğreti Doktrini (Doctrine) ile değiştiren analiz/yazım şemalarıdır. Somut kanun maddesinin yetersiz kaldığı ya da bulunmadığı; argümanın dürüstlük kuralı, hakkın kötüye kullanılması yasağı, ahde vefa, sebepsiz zenginleşme veya iyiniyet gibi genel ilke ve öğretilere dayandığı dosyalarda güçlüdür.

Ne zaman kullanılır

Somut kanun maddesi yetersiz veya yok; argüman genel hukuk ilkesine/öğretiye dayanacak.
Dürüstlük kuralı (TMK m. 2), hakkın kötüye kullanılması, ahde vefa, sebepsiz zenginleşme, iyiniyet gibi bir ilke merkeze alınacak.
