Übernahme-/Vermittlungsklausel und Abwerbung
- § 9 Abs. 1 Nr. 3 AÜG macht Vereinbarungen unwirksam, die dem Entleiher die spätere Einstellung des Leiharbeitnehmers verbieten; eine angemessene Vergütung für eine nach vorangegangenem Verleih oder mittels vorangegangenem Verleih erfolgte Vermittlung bleibt möglich.
- AGB-rechtlich deshalb keine pauschale "Abwerbe-Vertragsstrafe" durchwinken: Transparenz (§ 307 Abs. 1 Satz 2 BGB), Angemessenheit, Degression nach Einsatzdauer, tatsächlicher Vermittlungsbezug und Abgrenzung zu einem faktischen Einstellungsverbot prüfen.

- § 1 Abs. 1b AUeG: Verleihhoechstdauer 18 Monate.
