§ 327f BGB Aktualisierungspflicht
- Der Unternehmer muss erforderliche Aktualisierungen bereitstellen und den Verbraucher darüber informieren.
- Erforderliche Sicherheitsaktualisierungen gehören ausdrücklich dazu; reine Funktionserweiterungen folgen nicht aus Paragraf 327f BGB.
- Bei dauerhafter Bereitstellung gilt die Pflicht für den Bereitstellungszeitraum. Sonst ist der Zeitraum maßgeblich, den der Verbraucher nach Art und Zweck des Produkts, den Umständen und der Vertragsart erwarten kann.
- Rechtsprechung nur fallbezogen ergänzen. Solange keine einschlägige Entscheidung zu der konkreten Aktualisierungs- oder Änderungsklausel belegt ist, aus dem Wortlaut der Paragrafen 327f, 327r und 327s BGB sowie der Richtlinie (EU) 2019/770 arbeiten und kein Aktenzeichen ergänzen.
