- § 310 Abs. 4 Satz 1 BGB: Tarifvertraege, Betriebsvereinbarungen und Dienstvereinbarungen unterliegen nicht der AGB-Kontrolle.
- § 310 Abs. 4 Satz 2 BGB: bei Arbeitsvertraegen ist auf die Besonderheiten des Arbeitsrechts angemessen Rücksicht zu nehmen.

Versetzungsvorbehalt
- Klausel "Der Arbeitgeber kann den Arbeitnehmer an einen anderen Arbeitsort versetzen" ist im Regelfall transparenzbeduerftig.
- BAG, Urteil vom 25.08.2010 - 10 AZR 275/09: Entspricht der Versetzungsvorbehalt erkennbar dem Weisungsrecht aus Paragraf 106 Satz 1 GewO, findet keine Angemessenheitskontrolle nach Paragraf 307 Absatz 1 Satz 1 BGB statt; Unklarheit und Transparenz bleiben zu prüfen. Geht die Klausel darüber hinaus, ist ihre Angemessenheit zu kontrollieren.
Verfallklausel / Ausschlussfrist
- Klausel "Ansprueche aus dem Arbeitsverhaeltnis verfallen, soweit sie nicht innerhalb von 3 Monaten geltend gemacht werden" hat in der Tendenz Bestand, wenn:

Rueckzahlungsklausel für Aus- und Fortbildung
- Klassische BAG-Linie: nur wirksam, wenn:
- der Mitarbeiter einen geldwerten Vorteil aus der Fortbildung zieht,
- die Bindungsdauer in einem angemessenen Verhältnis zur Fortbildung steht (Faustregel: bis 1 Monat — kein Bindung, 1-2 Monate — bis 6 Monate, 2-4 Monate — bis 1 Jahr, 6-12 Monate — bis 3 Jahre, > 24 Monate — bis 5 Jahre).
- Klausel muss differenzieren nach Kuendigungsgrund (Eigenkuendigung des Arbeitnehmers schadet, betriebsbedingte Kuendigung des Arbeitgebers nicht).
Vertragsstrafe im Arbeitsvertrag
- Die Paragrafen 307 bis 309 BGB gelten grundsätzlich auch für Formulararbeitsverträge; arbeitsrechtliche Besonderheiten sind nach Paragraf 310 Absatz 4 Satz 2 BGB zu berücksichtigen. Eine Vertragsstrafe ist nicht pauschal bis zu einem Bruttomonatsgehalt zulässig, sondern nach Pflichtverstoß, Kündigungsfrist, typischem Schaden und Höhe zu prüfen.
