- Artikel 9 Rom-I-VO ist eng auszulegen. Aus der Funktion von Paragraf 242 oder den Paragrafen 307 bis 310 BGB folgt nicht pauschal, dass jede deutsche AGB-Norm eine Eingriffsnorm ist.
- Artikel 21 Rom-I-VO zum ordre public ist eine eigenständige, ebenfalls restriktive Ausnahme und kein Ersatz für eine unterbliebene Prüfung der Artikel 6 und 9.
