Haftungsbegrenzung prüfen und formulieren
1. Zweck und Anwendungsfall
Ausnahme, Haftungsgrund und summenmäßige Begrenzung müssen im Zusammenspiel stimmen. Gewährleistungsrechte, Verjährung, Vertragsstrafe und tatsächliche Schadensberechnung bleiben gesonderte Aufgaben.
2. Eingaben
Gesamte Haftungsregel, Vertragstyp, B2B/B2C, Pflichtenkatalog, geschützte Rechtsgüter, handelnde Personen, Entgelt, Schadensszenarien und Versicherungsschutz. Eine Versicherungssumme belegt nicht die Wirksamkeit eines Haftungsdeckels.
3. Ablauf
3.1. Tatbestand der Haftung und Reichweite des Ausschlusses bestimmen. Bei Personenschäden, Verschulden oder Gehilfen Haftungsausnahmen laden; eigene Vorsatzhaftung von Gehilfenhaftung unterscheiden.
3.2. Bei wesentlichen Pflichten, Folgeschäden oder Höchstbeträgen Schadensumfang und Obergrenze lesen. Geschützte Kernleistung konkret benennen. Kein festes Vielfaches des Entgelts als generell zulässig behandeln.
3.3. Alle Absätze auf Widersprüche prüfen: Ausnahmen müssen auch Jahresdeckel, Einzelereignisdeckel und Folgeschadenausschluss erfassen. B2B-Wertungen anhand Paragraf 310 BGB einordnen, nicht schlicht den Verbraucherkatalog kopieren.
3.4. Unwirksamen Umfang nach Paragraf 306 BGB bestimmen; Teilbarkeit nicht pauschal ausschließen. Eine konservative Ersatzfassung liefern. Bei Schäden aus Datenverarbeitung oder Modelldiensten ergänzend den eigenständigen Datenhaftungsdeckel prüfen, ohne den Grunddurchgang zu wiederholen.
4. Quellenpflicht
Zitierweise beachten. Paragrafen 276, 278, 307, 309 Nummer 7 und 310 BGB sowie gegebenenfalls Paragraf 14 ProdHaftG anhand des konkret erfassten Schadens prüfen. Entscheidungen und Grenzen sind in den beiden Referenzen zugeordnet.
5. Ausgabeformat
Haftungsmatrix als Zwischenprodukt, danach einheitliche ausformulierte Klausel mit Ausnahmen, konkreten Kernpflichten und begründeter Begrenzung. Endprodukte in vollständigen Sätzen; keine Skelette, Halbsätze oder bloßen Aufzählungen. Times New Roman 11 pt und dezimale Gliederung mit Leerzeilen; bei Markdown Exporthinweis.
