1. Zweck und Anwendungsfall
Vertragliche Obergrenzen für digitale Leistungen anhand der tatsächlichen Risikoverteilung beurteilen. Kein allgemeiner Rechtscheck automatisierter Systeme und keine abschließende Prüfung von Meldepflicht, Bußgeld, Organhaftung oder deliktischen Drittansprüchen.
2. Eingaben
Vertrag und Nachträge, Leistungszusagen, Datenkategorien, eingesetzte Modelle, Wiederherstellbarkeit, Entgelte, Versicherungsdeckung, Schadensmeldungen, Logs, Kundenkommunikation und interne Freigaben. Personenbezogene Daten nur soweit erforderlich auswerten.
3. Ablauf
3.1. Den Geschäftsvorgang und das verlangte interne oder externe Arbeitsprodukt konkretisieren. Zwischen Vertragsentwurf und bereits eingetretenem Schaden unterscheiden.
3.2. Daten- und Modellrisiken für Szenarien, Übergangsrecht und Entscheidungsvorlage lesen. Nur die tatsächlich betroffenen Risikotypen untersuchen.
3.3. Schadensumfang, vertragliche Kernpflicht, Verantwortungsbereich und vorgeschlagene Obergrenze je Szenario gegenüberstellen. Fehlt die allgemeine Haftungsprüfung, gezielt Haftungsbegrenzung hinzunehmen; vorhandene Ergebnisse wiederverwenden.
3.4. Ausnahmebereich, Einzel- und Gesamthöchstbetrag sowie Risikoreserve begründen. Unwirksamkeit, Schadensersatz und sonstige Rechtsfolgen nicht vermengen. Ungeklärte Deckung nicht als Freigabe darstellen.
4. Quellenpflicht
Zitierweise und die fallbezogenen amtlichen Quellen in der Referenz beachten. Die Richtlinie (EU) 2024/2853 ist keine pauschale Grundlage einer bereits geltenden vertraglichen Haftungsgrenze. Nationales Umsetzungsrecht und zeitlicher Produktbezug sind getrennt zu prüfen.
5. Ausgabeformat
Einseitige Entscheidungsvorlage mit Empfehlung, Belegmatrix, Risiken, Optionen, zuständiger Person und Entscheidungsdatum sowie ausformuliertem Änderungsvorschlag. Nur falls beauftragt eine interne Weisung oder ein adressatengerechtes Schreiben daraus ableiten. Keine Skelette, Halbsätze oder reinen Aufzählungen als Endprodukt. Times New Roman 11 pt, dezimale Gliederung mit Leerzeilen; bei Markdown Exporthinweis.
