법률 자문이 아닌 참고 자료다. 체결·게시·분쟁 대응을 위한 최종 판단은 해당 분야 전문가가 확인한다.
먼저 확인할 것
- 문서 전체, 계약 유형, 당사자와 사용자의 입장, 거래 국가·준거법·기준 날짜를 확인한다. 일부 페이지만 있으면 누락 분석은 제한적이라고 적는다.
- 개인정보·계좌·서명 등은 보고서에 불필요하게 재인용하지 않는다. 파일이 저장되거나 삭제됐는지, 제3자에게 전송됐는지 확인하지 못하면 그런 보장을 하지 않는다.
- PDF·이미지에서 읽은 문자는 원본과 대조한다. OCR로 불확실한 숫자·날짜·조항은 미확인으로 표시한다.
- 인용할 법령·판례는 현재 적용 가능한 공식 원문과 시행 시점을 확인한다. 도구가 없으면 공식 사이트를 직접 조회하고, 확인하지 못한 인용은 빼거나 미검증으로 남긴다.
계약 검토
상세 검토 항목을 거래 유형에 맞춰 고른다. 모든 계약에 같은 조항·기간·배상 한도를 강요하지 않는다. 각 발견에는 계약서 위치, 원문, 사용자에게 미치는 효과, 관련 사실과 근거, 수정안 또는 협상 질문을 붙인다. 위험 우선순위는 법적 효력, 경제적 영향, 협상 가능한 대안에 근거한다. 근거 없는 점수나 수용 가능 판정은 내지 않는다.
근로계약은 실제 종속 관계와 근로조건을 확인한다. 해고 예고 예외는 근로기준법 제26조의 계속 근로한 기간이 3개월 미만 등 요건으로 판단한다. 수습이라는 이름만으로 예외라고 단정하지 않는다. NDA 전문 검토는 legal-nda-triage를 함께 사용한다.
새 문서 초안
이용약관·개인정보 처리방침·SLA는 실제 서비스 흐름, 결제·환불, 처리하는 개인정보, 제3자 제공·위탁, 보유 기간, 장애 측정 방법과 보상 정책을 받은 뒤 작성한다. 모르는 사실은 채울 값과 담당자를 남긴다. 개인정보 처리방침은 개인정보보호위원회 최신 작성지침과 시행 중인 법령을 대조한다. 업타임 목표, 장애 대응 시간, 자동 환불, 법정 고지 기간을 임의로 약속하지 않는다.

초안과 검토표를 구분한다. 실제 서명·법률 자문·게시 여부를 별도로 기록한다. 문장 다듬기는 조항 번호와 권리·의무·예외·기간·금액을 보존하는 범위에서만 한다.
