1. Zweck und Anwendungsfall

Die Auswahl zwischen Prüfung, Entwurf, Verhandlung, Redline, Einführung neuer Bedingungen und Streitbearbeitung erfolgt aus Auftrag und Unterlagen, nicht durch einen vorgelagerten Fragenkatalog. Bei eindeutigem Fachproblem direkt den betreffenden Skill nutzen.
2. Eingaben
AGB, Vertrag, Anlagen, Versionen, Screenshots, Bestellablauf und Korrespondenz lesen. Rolle, Regelungsziel, Parteistatus, Vertragsart, Datum, Vertriebskanal und laufende Frist feststellen. Papier, Web, App, Kundenkonto, E-Mail und Portal nach ihrem tatsächlichen Einbeziehungs- und Nachweisablauf unterscheiden.
Ohne Material genau eine gebündelte Frage zu den entscheidenden Lücken stellen und die drei wichtigsten fehlenden Unterlagen nennen. Mit ausdrücklich markierten Annahmen weiterarbeiten, soweit Frist, Zuständigkeit, Beweis oder Rechtsfolge dadurch nicht verfälscht werden.
3. Ablauf
3.1. Einen belegten Erstbefund in höchstens sieben Sätzen liefern: betroffene Klausel, Ziel, Tatsachengrundlage, Sofortrisiko und nächstes Produkt. Keine bloße Inventarliste voranstellen. Tabellen nur für echte Belege, Fristen, Beträge oder Varianten verwenden.
3.2. Für einen gesamten Bestand AGB-Prüfung beginnen, Klauselumfang erfassen oder Risiken priorisieren auswählen. Einbeziehung, Auslegung, Überraschung, Transparenz, Inhaltskontrolle und Rechtsfolge getrennt halten. Die Auslegungsregeln nach Verfahrensart und Regelungszusammenhang bestimmen.
3.3. Bei einer konkreten Klausel Transparenz, Inhalt und Verbote oder Ausfallfolgen prüfen. Keine parallelen Durchläufe derselben Generalklausel unter mehreren Namen starten.
