⚠️ Novità normativa (verificato giugno 2026)
La L. 9 giugno 2025, n. 80 (conversione del D.L. Sicurezza 48/2025) ha introdotto il reato di rivolta all'interno di istituto penitenziario: reclusione 1–5 anni per la partecipazione a sommossa mediante violenza, minaccia o resistenza agli ordini; fino a 8 anni per chi la organizza o dirige; fino a 20 anni se ne derivano lesioni gravi o morte. Il reato si configura solo per violazione di ordini impartiti per la tutela dell'ordine e della sicurezza interna — non per ordini generici: è il primo terreno difensivo. La legge modifica anche altre disposizioni dell'ordinamento penitenziario.
